The practice at Bath & Edmonds, P.A., is devoted solely to representing individuals and businesses, in responding to and defending against, criminal investigations and other governmental inquiries.

Each of our attorneys are all former prosecutors (three State and one Federal) who have a minimum of 15 years and up to 30 years of criminal law experience. Our attorneys have tried in excess of 300 felony jury trials and 1000 bench trials. Both local and national publications have recognized the firm as possessing extensive courtroom experience.

In State and federal court police often make an arrest or execute search warrants, but do not immediately file charges. It is wrong to assume that since no charges were filed then the case has been rejected by the prosecutor. In fact, the prosecutor has, at a minimum, 2 years in which to file charges. This allows the police more than enough time to investigate the case and then present their findings to the prosecutor.

Hiring an attorney immediately after an arrest or an investigation is crucial as it will allow counsel to conduct their own investigation, meet with you and explain how the process works and meet with the prosecutors and/or police to explain why charges should not be filed. As former prosecutors, the attorneys at Bath & Edmonds have successfully overseen the investigation of hundreds of cases resulting in "no charge" decisions by prosecutors.

March 2013

In early 2012 a young professional from out-of-town was attending a business convention in Kansas City, Missouri. He and two of his friends met three women at a local entertainment district. The women invited the men to their rooms. Later in the evening the police were called and an allegation was made that the young man engaged in sexual assault against one of the women. The basis of the assault that while both of them were intoxicated the woman was too intoxicated to "consent to any sexual activity".

Despite having never been in trouble in his life the police arrest him and within a few hours the prosecutors charge him with rape. Bath & Edmonds is engaged and assist the young man in making bail and zealously defend the young man. In addition to taking depositions Bath & Edmonds engage their own experts and aggressively litigate the matter over the next 12 months. The matter is set for jury trial and approximately 6 weeks prior to the start of the trial all charges are dismissed.

December 2012

In 2010, Bath & Edmonds is hired to represent a local man charged with arson. During his cooperation with the police the client adamantly denied any involvement and maintained he was innocent. The client advised the firm that he would not accept any plea offer. Over the next two years Tom and Tricia Bath aggressively litigated this matter. In the summer of 2012, the matter was set for a jury trial in December 2012. Approximately three days before trial the prosecutors dismissed the charges.

A local business woman got into a dispute with her estranged husband that resulted in her being arrested for "domestic violence". She was charged with one count of criminal damage to property. The district attorney's office offered her to resolve the case through what is known as a "diversion program". She hired Tom Bath to represent her. After review of the evidence and consultation the client declined any plea bargains. Approximately two weeks before the matter was set for a jury trial all charges were dismissed.

Tom Bath

Tom is one of the State's premier trial lawyers. With more than 20 years of trial experience, he has handled thousands of cases throughout the State of Kansas. He has been selected by his peers for inclusion in the Best Lawyers in America, widely regarded as a guide to the nation's best attorneys.

Tom has also represented individuals in Federal court on matters including public corruption, bribery, bank robbery, narcotics distribution, RICO and prescription fraud. Tom's state practice includes every type of allegation including embezzlement, securities fraud, narcotics, vehicular homicide, DUI, robbery, sexual assault and murder.

From 1986 to 1992 Tom was an Assistant District Attorney where he prosecuted numerous high profile cases and was recognized in 1992 as the prosecutor of the year in the State of Kansas. Since 1992 his practice has focused on criminal defense. Tom is one of a select few who are asked by the courts (State and Federal) to represent persons charged with capital murder. Tom has been a featured speaker and panelist on numerous state and regional conferences addressing criminal law.

Tom is active in various local and state bar activities. He is a former president of the Johnson County Bar Foundation and was on the Board of Directors for the Johnson County Bar. In 2000 and again in 2004 Tom was elected by his peers to serve on the Supreme Court Nominating Commission where he participated in the nomination of five Supreme Court and eight Court of Appeals candidates.

  • Robb Edmonds

    Since first becoming licensed to practice law in 1985, Robb has practiced exclusively in the general area of criminal law, both as a prosecutor and as a defense attorney. He is respected among judges, prosecutors, corrections officers and fellow defense attorneys as a lawyer with a deep sense of commitment to his client's problems, to include those problems occurring outside of the courtroom.

    After graduating from Washburn Law School in 1985, Robb was sworn in as an officer of the United States Army, Judge Advocate General's Corps. After 6 months in the JAG Corps Robb was promoted to the rank of Captain. Acting first as a defense attorney, and then as a prosecutor, Robb spent 3 + years in Germany and Belgium defending and prosecuting soldiers in various court martial proceedings, to include rape, attempted first degree murder and second degree murder. After leaving active duty Robb remained the in U.S. Army, active reserves, until 1992.

    Upon returning to his home of Johnson County, Robb was hired in 1989 by the Johnson County District Attorney. Robb worked 3 years in the District Attorney's office, primarily prosecuting felony drug cases. Necessarily, by the nature of drug cases, Robb was involved in multiple cases litigating Fourth Amendment and Fifth Amendment issues, both at a trial and appellate level. In 1992, Robb left the DA's office to go to work with Carl Cornwell, practicing as Cornwell and Edmonds for 5 years.

    In 1997, Robb and Tom Bath, acting upon their association in the Johnson County District Attorney's office, founded Bath & Edmonds, created upon a commitment to bring the highest level of result oriented representation to its clientele of persons and corporations investigated or charged with criminal acts.

    Presently, Robb serves voluntarily to take judicial appointments to federal cases docketed in the District of Kansas, as well as juvenile court appointments in the 10th Judicial District. As to juvenile court matters, because of his expertise, Robb is often solicited by judges to take particularly complicated, serious and high-profile matters. Robb also has experience representing juveniles in a variety of school-expulsion hearings.

    Over the years, Robb has often been asked to speak at various conferences and seminars, on a variety of legal topics. Most recently, Robb spoke at the 2009 annual convention of the Kansas Bar Association on the topic of ethics in criminal defense.

    Over the last 20 plus years, Robb has represented literally thousands of persons, in all types of courts and in all types of criminal proceedings, from the most simple bench trial to the most complicated jury trial of a homicide or drug distribution conspiracy.   • Tricia Bath

    Tricia has practiced exclusively criminal defense with Bath & Edmonds for more than ten years. As a former prosecutor, Tricia has an intimate understanding of criminal procedure and the rights of the criminal defendant. A gifted writer, Tricia puts this understanding to work in her motion and appellate practice.

    Tricia represents clients at all levels of criminal charging, from Municipal Court offenses to serious State and Federal allegations. Tricia's Municipal Court practice includes defense of DUI and other alcohol-related offenses as well as battery, theft, marijuana possession and minor traffic offenses. In State Court, Tricia defends both adults and juveniles in misdemeanor and felony matters involving: drugs and alcohol, property crimes, physical and sexual assaults and murder, including death penalty cases.   • Robin D. Fowler

    Robin Fowler graduated from the University of Kansas Law School in 1983, and served as an Assistant District Attorney in Douglas County, Kansas, after having interned in that office while in law school. In Douglas County Robin prosecuted a wide variety of misdemeanor and felony cases, and had numerous jury trials on charges ranging from traffic offenses to rape and kidnapping.

    From there Robin moved to the Kansas Attorney General's Office, serving as an Assistant Attorney General assigned to the Kansas Bureau of Investigation. His duties included crimes on a state-wide level, while also serving as the legal advisor for the KBI.

    In 1985 Robin became an Assistant United States Attorney for the District of Kansas, serving in many capacities until 2002, except for a two year leave of absence in the United States Army. Robin handled virtually every type of federal criminal offense, including drug and firearm offenses, armed robbery and other violent federal crimes, and many types of white collar crime. From 1999-2002 Robin served as chief of the Kansas City, Kansas branch office, supervising attorneys and support personnel in that office.

    Since leaving the United States Attorney's Office in 2002 to join Bath & Edmonds, Robin has been primarily involved in defending persons charged, or being investigated, for a wide range of federal offenses. Robin has represented such persons in numerous white-collar fraud investigations; as well as tax, firearm and drug-related cases. Robin has represented individuals charged in federal courts in Kansas, Minnesota, and both the Eastern and Western Districts of Missouri. Robin has been recognized for his white-collar defense work by his selection in the well-known and respected publication Best Lawyers in America.

    In early 2012 a young professional from out-of-town was attending a business convention in Kansas City, Missouri. He and two of his friends met three women at a local entertainment district. The women invited the men to their rooms. Later in the evening the police were called and an allegation was made that the young man engaged in sexual assault against one of the women. The basis of the assault that while both of them were intoxicated the woman was too intoxicated to "consent to any sexual activity".

    Despite having never been in trouble in his life the police arrest him and within a few hours the prosecutors charge him with rape. Bath & Edmonds is engaged and assist the young man in making bail and zealously defend the young man. In addition to taking depositions Bath & Edmonds engage their own experts and aggressively litigate the matter over the next 12 months. The matter is set for jury trial and approximately 6 weeks prior to the start of the trial all charges are dismissed.

    December 2012

    In 2010, Bath & Edmonds is hired to represent a local man charged with arson. During his cooperation with the police the client adamantly denied any involvement and maintained he was innocent. The client advised the firm that he would not accept any plea offer. Over the next two years Tom and Tricia Bath aggressively litigated this matter. In the summer of 2012, the matter was set for a jury trial in December 2012. Approximately three days before trial the prosecutors dismissed the charges.

    A local business woman got into a dispute with her estranged husband that resulted in her being arrested for "domestic violence". She was charged with one count of criminal damage to property. The district attorney's office offered her to resolve the case through what is known as a "diversion program". She hired Tom Bath to represent her. After review of the evidence and consultation the client declined any plea bargains. Approximately two weeks before the matter was set for a jury trial all charges were dismissed.

    Super Lawyers (Missouri & Kansas) Magazine names Tom Bath and Robin Fowler as Super Lawyers. Tom was included in the "top 100" lawyers who received the highest point totals in the 2012 nomination research process (as well as named "top 50 in Kansas City").     September 2012

    Client charged in Douglas County, Kansas (Lawrence) with possession with intent to sell prescription medication. The State offers a plea to a felony drug conviction. Bath & Edmonds files motion to suppress arguing that the police illegally seized and searched evidence located in client’s apartment. Upon review of the argument and authorities contained in the motion to suppress, the prosecutor offers a plea to misdemeanors, no shock time and probation.

    In October of 2011, the Catholic Diocese of Kansas City St. Joseph was indicted in Jackson County, Missouri for failing to report suspicions of child abuse. The Diocese hires Bath & Edmonds, P.A. After eleven months of investigations, depositions and litigation, the matter concluded with all charges against the Diocese being dismissed by the State.

    Leavenworth County District Court: Client hired Bath & Edmonds after pleading to felony drug offense. Client was awaiting sentencing, but felt that he did not receive adequate representation and that his plea to the felony was not voluntary. The firm litigated the matter including filing motions to withdraw the plea which were successful. New plea negotiators were entered into wherein the County Attorney agreed to misdemeanor paraphernalia, one year probation with no shock time.

    A Kansas City, Kan., police officer charged in an off-duty shooting incident last Christmas has resigned and pleaded guilty to a misdemeanor battery charge. Michael Mills, 32, also entered no-contest pleas in Wyandotte County District Court to two misdemeanor counts of criminal restraint stemming from the incident.

    Mills initially was charged with felony counts of aggravated assault and criminal discharge of a weapon for allegedly firing at an occupied vehicle in the street near his home in western Wyandotte County. No one was injured.

    The plea agreement calls for Mills to serve 30 days in jail as part of his 18-month probation. If he violates probation, he could be ordered to serve up to two years in jail, according to the district attorney's office.

    He was required to surrender his firearm and his certification as a Kansas law enforcement officer.

    Mills' attorney, Tom Bath, said that the original felony charges carried a presumptive prison sentence and would have required Mills to be listed on the state's offender registry.

    "This allowed him to resolve these issues and get on with his life, " Bath said.

    The pleas came late Monday as Mills' trial on the felony charges was about to get under way.

    July 2012

    Bath & Edmonds is hired to represent a young man charged with possession of child pornography found on the computer located in the accused's home. The firm undertakes an extensive forensic examination and presents compelling evidence to the prosecutor's office regarding the computer evidence. The firm obtains a reduction in the charge to a Level 9 felony with a 6 month sentence suspended with a 12 month probation, with no offender registration. The initial charge carried a 32 month sentence in a "border box" with lifetime sexual offender registration.

    April 2012

    Based upon his significant courtroom experience with computer forensics Tom Bath is asked by the Kansas Bar Association to give a presentation on computer forensics to the Criminal Law section.

    Ingram's Magazine publishes a list of the top talent and legal specialties most relevant to businesses in the Kansas City region. In the Trial/Litigation section, the magazine states "Thomas Bath of Bath & Edmonds is a former prosecutor with a prodigious appetite for court room work, trying roughly 350 bench and jury trials in 26 years of white-collar defense work stemming from various sectors and health care, financial services and governmental investigation."

    March 2012

    Robin Fowler is inducted into the American College of Trial Lawyers. The College recognizes the top trial lawyers in the nation. Robin is one of only 57 attorneys in Kansas to belong to the College. Robin joins Tom Bath as a member of the College. The College is considered among the country's most prestigious legal organizations. Fellowship in the College is extended only by invitation, after careful investigation, to those experienced trial lawyers who have mastered the art of advocacy and whose professional careers have been marked by the highest standards of ethical conduct, professionalism, civility and collegiality. Lawyers must have a minimum of 15 years of trial experience before they can be considered for fellowship.

    January 2012

    A 19 year old man is involved in a fight at a county fair wherein the other man sustains a broken nose. The fight resulted in his being charged with a level 4 felony. Bath & Edmonds is then hired. After an analysis of the reports and interviewing witnesses Bath & Edmonds presents their findings and convinces the prosecutor to dismiss the charge.

    January 2012

    In 2010, Bath and Edmonds is hired to represent a young man charged with possession of child pornography found on two hard drives located in the accused's home. Tom Bath undertakes an extensive forensic examination of the government's evidence. Eighteen months later, after numerous hearings and two jury trials (both ending in mistrials), the prosecutor dismisses the child pornography charges and amends the complaint (eliminating all references to a crime involving a sex offense) resulting in a plea agreement to obstruction of justice.

    December 2011

    In early 2011, a rural Kansas woman is involved in an automobile wreck on an ice covered road resulting in the death of a passenger and killing the driver of a second vehicle. Four months later the woman is charged with two felony counts (level 5) of involuntary manslaughter. She then hires Bath and Edmonds (B &E) to represent her. B & E employs investigators and an expert in accident reconstruction. Prior to trial the prosecutor is presented with the expert's reports. The prosecutor asks his expert to review these findings. After review of the findings the State then dismisses all charges.

    Local citizen charged with aggravated assault with a handgun for investigating a disturbance outside his home. Prosecutors allege the discharge of the weapon was directed toward the "victims ". Defense maintains that the use of the weapon was necessary in self defense regarding aggressive conduct by the "victims". Bath and Edmonds represents client at jury trial. Jury acquits citizen.
